CURIGWELSHGIFTS 'TERMS AND CONDITIONS OF SALE'

All orders for goods or services accepted by Curigwelshgifts.co.uk (Stephen Meyer T/A Curig Crafts & Woollens) are accepted subject to the following conditions, which shall form part and govern the contract of sale.  Acceptance of goods shall be deemed to be acceptance of these conditions of sale.

1. Payment and Price

All prices are in £ sterling, inclusive of VAT but excluding postage and packaging.
Postage & Packaging will be added automatically at the final stage of your order by the system. All charges are calculated on order value. See P&P below for rates.

  Price Lists do not constitute an offer.
All invoiced goods are due for payment at the time of order.
Payment is to be made in sterling via our Secure Online Payment facility.  Curigwelshgifts online secure shopping facility accepts all major debit and credit cards.  For the minority of customers who do not feel comfortable paying on-line we can sometimes accept card payment by telephone.

2. Availability of Goods.

 Items shown on this website may not always be in stock.  If any of your chosen items is not in stock, you will be advised of our best estimate of availability and delivery date.  Please note that an indication of such dates is an estimate only, may be subject to change without notice, and does not constitute a contractual obligation by Curigwelshgifts to supply goods by a certain date.  However, if availability is unduly delayed, we will use our best endeavours to keep you informed. This will normally be by email. To avoid these important messages ending up in your junk mail folder (especially but not exclusively users of Hotmail) please enter sales@curigwelshgifts.co.uk into your address book.

3. Delivery of Goods.

Curigwelshgifts aims to dispatch all orders as soon as possible after receipt.  If in the event of delay it is not possible to dispatch orders promptly we will advise you by e-mail.  

Certain items are delivered direct from our suppliers and may take between 7-14 working days.  The customer will be provided with an estimated delivery date along with an option to cancel.  

If items are temporarily out of stock and dispatch is anticipated to be unduly delayed the customer will be contacted by either email or phone to agree a new delivery date.  If this date is unsuitable, a full refund will be offered.

Please note: Delivery is by Royal Mail, normally Recorded Delivery where a signature is required on delivery. Curigwelshgifts cannot be held responsible for delays caused by the postal system.

4. Product Information.

Product images, descriptions and approximate dimensions have been designed to give as much information as possible about the product.  Product images are not displayed to actual size and where necessary products will be labelled " Not As Illustrated" when images are used for guidance purposes only.  Additional product information can be requested from Curigwelshgifts at any time.

5. Claims.

(a)     No liability for any claim for damage or non-functionality shall be accepted unless the purchaser notifies Curigwelshgifts in writing (via post or electronic mail) within 30 days of purchase giving as much information as possible.

No liability for any claim will be accepted in the case of goods differing in quantity or descriptions from the particulars given on the delivery note unless Curigwelshgifts is notified in writing by the purchaser within 30 days of purchase.  The onus is on the purchaser to prove any shortages.

This does not affect your statutory rights as a consumer.

6. Consumer Protection (Distance Selling) Regulations 2000.

All purchases made via our Online Store are subject to the UK Distance Selling Regulations.

Under the Consumer Protection (Distance Selling) Regulations 2000:
You have the right to cancel your order and receive a full refund with no financial penalty for any item or services.  
You may cancel your order by sending or delivering to us a cancellation e-mail or cancellation letter at any time up to and including seven days (excluding Saturdays, Sundays and Public Holidays) after the day on which you receive your purchase.  For the purpose of cancellation our contact details are provided below:

If you exercise your Statutory Right to Cancel your order, you must return to us at your expense the item or items that you wish to return.

7. Returned Goods Not covered by Distance Selling Regulations (Section 6 above)

(a) The vendor will not accept goods for credit or refund unless such return has been authorised by Curigwelshgifts, and the goods are received by Curigwelshgifts in stock condition, with original packaging.
(b) The purchaser shall, unless otherwise stated, or, if goods are being returned under the Distance Selling Regulations, be responsible for the cost of outward and return carriage and insurance of all goods returned by the purchaser to Curigwelshgifts for refund or credit.  The goods shall be at the risk of the purchaser until actual receipt by Curigwelshgifts.  The onus of proof of safe delivery shall rest with the purchaser.
(c) Curigwelshgifts shall refund postal expenses on returns of faulty or incorrectly supplied goods only.
(d) No credit or refund shall be made for goods until they have been received by Curigwelshgifts with original packaging.

8. Complaints Procedure.

This contract is and shall be deemed to have been made in Wales and shall in all respects be governed by the laws of England and Wales.  Your statutory rights are unaffected by these terms and conditions.
